Whisk Chat — Terms of Use

These Terms govern your use of the Whisk Chat application and services ("Whisk", "the Service") operated by Verdus Technologies Pte Ltd ("Verdus", "we", "us"). By creating an account or using Whisk, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use Whisk Chat. By accepting these Terms you confirm you meet this requirement.

If you are subject to a jurisdiction with a higher digital-services age of consent, that higher age applies to you.

2. Your account

You are responsible for keeping your email account and any signed-in devices secure.
You may not share your account with others or impersonate anyone.
You are responsible for all activity that occurs under your account.
If your device is lost or stolen, use the "Revoke device" function (Settings → My Devices) or contact [email protected] to disable it.

3. Acceptable use

You agree NOT to use Whisk Chat to:

Send, share, or store content that is illegal in Singapore or in the recipient's jurisdiction.
Distribute child sexual abuse material (CSAM). Any account found to be sharing such material will be terminated immediately and reported to law enforcement worldwide.
Harass, threaten, dox, stalk, or defame any person.
Distribute malware, phishing content, or otherwise attempt to compromise other users' devices.
Send unsolicited bulk messages (spam) or run automated botnets on the network.
Circumvent, disable, or interfere with security or authentication features of the Service.
Reverse-engineer, decompile, or disassemble the Service, except to the extent permitted by mandatory local law.
Resell, sublicense, or commercially exploit the Service without a separate written agreement with Verdus.

4. Content ownership and license

You own your content. Messages, files, images, and everything else you create in Whisk Chat remain yours.

You grant Verdus a limited, non-exclusive licence to transmit and briefly store the encrypted form of your content solely for the purpose of delivering it to the intended recipient(s), for a maximum of 30 days per Section 1.2 of our Privacy Policy.

Because the Service is end-to-end encrypted, Verdus cannot access, index, or moderate the plaintext of your content. Content moderation happens client-side on your device and the recipient's device.

5. Reporting abuse

If another user sends you content that violates these Terms, use the in-app Report function (long-press the message → Report) to notify us. Because the Service is end-to-end encrypted, your report to us includes only the reporter's user ID, the reported user's ID, and the reason you selected — the reported message content is not included. If you wish to share the content itself, please attach a screenshot in a follow-up email to [email protected].

Verdus reviews reports and may, at its discretion, suspend or terminate offending accounts.

6. Blocking

You may block any user at any time from the Contact Profile screen. Blocked users cannot send messages or files to you. Blocking is enforced by your device and by our servers (blocked users' messages destined for you are rejected).

7. Suspension and termination

Verdus may suspend or terminate your account without notice if:

You violate these Terms or applicable law.
Multiple abuse reports against you are substantiated.
Verdus is legally required to do so.
Your account has been dormant for more than 12 months and Verdus needs to reclaim resources.

You may terminate your account at any time by requesting deletion at [email protected]. Verdus will delete your data within 30 days of the request.

8. No warranty

Whisk Chat is provided "as is" and "as available", without any express or implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

Verdus does not warrant that:

The Service will be uninterrupted, secure, or error-free at all times.
Every message will always be delivered.
The Service will meet your specific requirements.

9. Limitation of liability

To the maximum extent permitted by law, Verdus's aggregate liability for any claim arising out of or relating to Whisk Chat is limited to SGD 100 (one hundred Singapore Dollars). Verdus is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill.

10. Third-party services

Whisk Chat integrates with several public data sources (see Section 4 of the Privacy Policy). Verdus is not responsible for the content or availability of those services and does not endorse them.

11. Changes to these Terms

If Verdus materially changes these Terms, users will be notified through the app before the change takes effect. Continued use after the effective date of the change constitutes acceptance.

12. Governing law

These Terms are governed by the laws of Singapore. Any dispute arising out of or relating to Whisk Chat will be subject to the exclusive jurisdiction of the courts of Singapore.
